Terms and Conditions of the Agreement

  1. The renter shall be responsible for the payment of the above rental fee.
  2. In the event of cancellation of the above rental(s), the Community Services Department staff must receive seven (7) days’ notice or the renter will be liable for the said rental.
  3. In the event of a mechanical failure, power outage and other causes beyond control, the Huron-Kinloss Community Services Department assumes no responsibility for loss of rental space, time or expected revenue and is in no way obligated to arrange and pay for facilities at another center. The Community Services Department staff will make an attempt to reschedule lost space at a later date if available.
  4. The Huron-Kinloss Community Services Department staff reserves the right to cancel, postpone or re-schedule bookings if such time is needed for other previously arranged activities.
  5. The Township of Huron-Kinloss shall not be responsible for any injury to any members of the rental group during their rental period, nor any loss or damage of their personal items or equipment kept or stored on the premises.
  6. The renter understands and expressly assumes all dangers of activities, the Facility, and location. The renter shall identify and inform the Community Services Department staff of any hazardous or dangerous equipment or conditions jeopardizing the safety of the renter or guests thereof and waives all claims arising out of the activities and from the Facility and location, whether caused by negligence, breach of contract, or otherwise or for bodily injury, property damage, or loss or otherwise.
  7. The renter shall be responsible and compensate the Township of Huron-Kinloss for any willful damage caused to the Facility or any equipment by any member of the rental group during their usage. The renter shall leave the Facility in a clean and undamaged condition. Any costs incurred by the Township of Huron-Kinloss to clean the Facility after a rental shall be charged back to the renter.
  8. All alcohol on the premise must be purchased from the Community Services Department. Unlicensed alcohol is prohibited.  If the renter is caught consuming unlicensed alcohol, their rental will be cancelled immediately.
  9. The renter is responsible for ensuring that anybody under the age of 19 is not consuming alcohol in the Facility.
  10. Smoking cannabis or tobacco and vaping of any substance is strictly prohibited on and within 20m of the Facility and property. This includes all areas and rooms in the Facility, the Parking Lot, and in any Vehicle parked in the Parking Lot. The renter assumes responsibility for all persons attending their event and will be subject to a fine(s) from Grey Bruce Public Health if Smoking and Vaping occurs on or within 20m of the Facility Property.
  11. The renter will not be allowed to rent the Facility until the Community Services Department staff has received the signed agreement, and payment of the rental fee in full.
  12. The rental time is as indicated on the contract. Any ‘setup’ or ‘clean up’ must be included in the rental time.
  13. Interest is charged on all accounts over 30 days. The current rate is 1.25% per month.
  14. This agreement does not bind the renter and/or the Huron-Kinloss Community Services Department to any further rental commitments beyond the dates set out above.
  15. On behalf of myself and the renter, I/we hereby release and indemnify the Township of Huron-Kinloss, its Council, officers, directors, agents, representatives, employees and volunteers from all liability, recourse, proceedings, claims, and causes of action of any kind whatsoever, including but not limited to, any claims under the Occupiers’ Liability Act, R.S.O. 1990, c. O.2., as amended and the Negligence Act, R.S.O. 1990, c. N.1, as amended, or any other statutory duty of care, any negligence, or breach of contract, and damages, for costs or expenses of whatsoever kind, nature, or description, whether direct or indirect, present or future, whether known or unknown, and any injury, including but not limited to death, arising out of or connected to my contraction of, or being exposed to, COVID-19, COVID-19-related, or other communicable diseases, through my accessing or use of a program space or any services received from the Township of Huron-Kinloss. This release shall be binding upon my heirs and personal representatives.

Assumption of Risk and Indemnifying Release

While Township of Huron-Kinloss staff and volunteers will make every reasonable effort to minimize exposure to known risks associated with each Registrant’s participation in a Township of Huron-Kinloss program (“Program”), I hereby acknowledge that I and/or my child if I am registering on his/her behalf (collectively, the “Registrant”) may be required, depending on the nature of the program, to participate in various physical activities that may involve a risk of injury. In this regard, I hereby permit the Registrant to participate in the full range of Program activities. In consideration of the Registrants opportunity to participate in the Program, the receipt and sufficiency of which is hereby acknowledged, I hereby release and hold harmless the Township of Huron-Kinloss, its respective officers, directors, employees, volunteers and agents, and their respective successors and assigns from any and all liability for damages sustained in consequences of loss, injury or damage to the Registrant, and from all other actions, causes of action, claims, demands or damages of any kind with respect to death, injury, loss or damages to any person or property arising out of or connected with preparation for, or participation in, the Program.

MUNICIPAL FREEDOM OF INFORMATION AND PRIVACY ACT
In accordance with the Municipal Freedom of Information and Privacy Act, personal information is collected under the Authority of the Municipal Act, R.S.O. 1990, c.M45, as amended, and will only be used for the purpose of maintaining adequate records of participation and enrollment in recreation programs and for medical information when required in emergency situations.
